Domestic Violence ends in Shooting (but not what you think)

Normally when you see that title, you think, domestic abuse escalated to the point where the abuser shot the victim.  This story has a bit of a twist..

As reported in the lapd blog. Man confronts his ex girlfriend in a garage and starts stabbing her with a pocketknife.  The womans daughter comes out to help her mom and starts getting stabbed as well.  The daughter’s boyfriend comes out and shoots the man dead.  Woman and daughter, although hospitalized, will survive.

Is your first concern really whether the boyfriend’s gun was legal or not or if citizens should carry guns at all?

Second thought for your consideration…. If the boyfriend called the cops, how long would it have taken for them to arrive? Would the woman and her daughter have been dead by then, or, would the attacker have shown mercy and stopped before he stabbed them to death?

These are the stories you don’t here.  Hats off to LAPD for actually bringing this to the public attention.   Then again, LAPD did arrest the boyfriend for murder.

Obama Biden – Permanent Assault Weapon Ban, Close “gunshow” loophole

To quote from the whitehouse.gov page on urban police:

Address Gun Violence in Cities: Obama and Biden would repeal the Tiahrt Amendment, which restricts the ability of local law enforcement to access important gun trace information, and give police officers across the nation the tools they need to solve gun crimes and fight the illegal arms trade. Obama and Biden also favor commonsense measures that respect the Second Amendment rights of gun owners, while keeping guns away from children and from criminals. They support closing the gun show loophole and making guns in this country childproof. They also support making the expired federal Assault Weapons Ban permanent.

With a democratic legislative body, these seem like that will rapidly become done deals.  Great.

So, going through them:

From wikipedia, The Tiahart amendment..
… prohibits the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) from releasing information from its firearms trace database to anyone other than a law enforcement agency or prosecutor in connection with a criminal investigation. Additionally, any data so released is inadmissible in a civil lawsuit. Some groups, including the Mayors Against Illegal Guns Coalition, believe that having further access to the BATFE database would help municipal police departments track down sellers of illegal guns and curb crime. These groups are trying to undo the Tiahrt Amendment.

Gun checks were made to stop criminals from getting guns. NOT to make public rosters of gun owners.  The Tiahrt amendment does NOTHING to stop a DA from doing a gun trace during a criminal investigation.  But it does protect private citizens from other such queries or from national databases of gun owners being created.

The gun show loophole is a myth.  Purchases at gun shows require background checks and have for some time.

The assault weapon ban… Well, which one do they want permanent?  The AR and >10 rd magazine law from 1994 or the one they tried to pass in 2006 that would ban ANY centerfire rifle based on a military design (I think that’s all of them).

This is a pretty harsh stance on 2nd amendment rights.  Please let your representatives know how you feel.  It won’t do any good, but, you might as well speak with experience when you say democracy doesn’t always work.

Man attempts to stop carjacking — Killed in attempt

18 year old Javier Villareal tried to stop a carjacking in Pacoima on the 11th at 1:05am with a gun.

Unfortunately, at least one of the 3 carjackers was also armed and killed Villareal.  Somewhat sad to see bad things happen to people that try to do the right thing.

Aggressive Militant Police Tactics Continue to Grow Unchecked.

A bit out of the scope for what I normally post.  But, seriously, if you don’t follow what SWAT has become; if you don’t know what the term “no-knock” warrant refers to.; if you haven’t been following the abuse of non-lethal force; and, if you don’t see the schism that has been growing between our police and the general populace.. here is a nice recent review.

Need More?  What was a black man doing owning a home anyway?

Police wouldn’t shoot a helpless man if they thought they weren’t be watched, would they?

Its a good thing that police have to worry about personal accountability…. Or do they?

Our police have a very tough job.  Most of them are very good at what they do and take their civic responsibility very seriously.  My personal belief is, however, that the more they are separated from the populace they are hired to protect, the more they become like an occupying army and less like a police force.  The same mentality that makes it ok for police departments to get hand-me-downs from the military –  The same mentality that makes civil forfeiture a legitimate form of fund raising rather than being perceived as the outright theft that it is — The same mentality that makes it ok for police to have guns and for citizens not to have guns.  These are the beliefs that ultimately lead to a very unhealthy partitioning between our guardians and the things they are truly hired to protect.

Obama and 2nd Amendment Concerns

With 8 days remaining until the inauguration, many firearm enthusiasts are concerned.  In addition to expecting another 2006-esque attempt at making all semi-automatic rifles illegal “assault rifles”, John Lott has written a very nice piece about Obama’s choice of Eric Holder as the next Attorney General and what it will mean for 2nd amendment rights.

The Firearms Coalition website has some nice tips for being activist in stopping this appointment.

Are you obeying firearms laws? Are you sure?

This guy thought so too: Man arrested at LAX for illegal pitstop…

The rule of thumb for firearm transport is that you can transport properly stored firearms between two locations if you are legally allowed to possess the firearms in those two locations.  The law tends to include gas stations, restaurants, etc. as reasonable stops.

Surprise!  Apparently there is a weird law in CA that makes it illegal to stop if you are carrying your legal, registered, assault rifle.
